Residence permit grounds in Azerbaijan, explained

A temporary residence permit (müvəqqəti yaşama icazəsi) is granted on one of the grounds listed in Art. 45 of the Migration Code. The ground decides the documents, the conditions and whether you need a work permit. Pick the right one and the rest is paperwork.

How a permit works

You enter on a visa, register your stay, and apply for the permit from inside the country through the State Migration Service. A first permit is issued for up to one year and can be extended for up to two years at a time while the ground continues. The permit comes as a card that also serves as your identity document in Azerbaijan, and it lets you leave and re-enter without a visa.

The grounds most people use

Head or deputy head of a branch or representative office (Art. 45.1.6)

For people appointed to those positions by a foreign legal entity that has registered a branch or representative office in Azerbaijan. Documents: the notarised statute of the branch, the registry extract, and the parent's power of attorney to the head, or the appointment document for the deputy. There is no capital, investment or turnover condition on this ground. Both positions are exempt from a work permit under Art. 64.0.13. This is the ground our branch route relies on.

Head of a local company with a foreign founder (Art. 45.1.6-1)

For the head of an Azerbaijani company founded by a foreigner. Work-permit exempt, but the notes to Art. 45 attach a paid-in capital condition of about 50,000 AZN and, from the second year, a turnover condition, unless the company holds a startup certificate. This is the ground that makes a small LLC a poor vehicle for a relocating founder.

Employee with a work permit (Art. 45.1.8)

For foreigners employed by an Azerbaijani employer, including a branch, who hold a work permit. The employer applies for the permit, pays 1,000 AZN for one year, and the residence permit follows. Refusal grounds for the work permit include a qualified local candidate being available for the position, so job descriptions matter. This is the fallback for any staff member who is not a head or deputy.

Family member of a permit holder (Art. 45.1.5)

For the spouse, children under 18 and dependent parents of a foreigner who already holds a temporary or permanent residence permit. The family applies after the sponsor's card has issued. Documents: the sponsor's permit and passport, the marriage or birth certificate legalised and translated, the sponsor's notarised consent unless he attends, medical certificates, accommodation and stay registration. See the family guide.

Owner of real estate (Art. 45.1.1)

For foreigners who own property in Azerbaijan above a value threshold, currently 100,000 AZN. Documents: the extract from the property register and a valuation. No employment or company required. We confirm the threshold in force at the time of filing, because it has been changed before.

Investor (Art. 45.1.2) and other grounds

Investment of at least 500,000 AZN in the economy, study at an accredited institution, marriage to an Azerbaijani citizen, close relatives of citizens, highly qualified specialists, and a handful of narrower cases. Each has its own document list. If none of the grounds above fits you, ask us and we will say which of these might.

Documents every applicant needs

Fees, timing and the 30-day rule

Child under 1860 AZN · 20 working days100 AZN · 15 working days

The 30-day rule. Art. 47.1 requires a residence application to be lodged at least 30 days before your permitted stay ends. On a 30-day e-visa that means filing in the first days after arrival, or extending the stay first. Enter on a 90-day consular visa if you can, or plan the extension on day one.

Applications are filed online on the State Migration Service portal, fingerprints are given in person on the appointment date, and the card is collected in person. Children under 15 give no fingerprints.

Extension and permanent residence

An extension is filed before the current permit expires, on the same ground, with updated documents. After two years of temporary residence the holder may apply for a permanent residence permit under Art. 52; the branch head and deputy head positions are listed there too (Art. 52.1.9), so the branch route leads to permanent residence without changing ground. Permanent residents can later apply for citizenship under the separate citizenship law.
